Terms & Conditions

Velvetra (“we”, “our”, “Company”) operates this website to sell women’s innerwear online. By using our website or placing an order, you (“you”, “Customer”) agree to these Terms & Conditions, which comply with Indian law (including the Information Technology Act, 2000 and its rules, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020). We also include standard international provisions to support future global operations. Please read these terms carefully. If you disagree with any part, you should not use the site or place an order.
1. Eligibility and Acceptance
•    You accept these Terms by using the site or purchasing from Velvetra. We may modify these Terms at any time; continued use constitutes acceptance of the updated Terms.
2. Company Information and Compliance
•    Corporate Details: Velvetra is a brand operated by Velvetra Sourcing, Address: 13/131, Geeta Colony, Delhi, India (GSTIN: 07AAZFV4501G1ZU). These details are disclosed as required by law.
•    Legal Compliance: Velvetra adheres to all applicable laws and regulations. In particular, we follow the Consumer Protection Act 2019 (with rules effective July 23, 2020) and the E-Commerce Rules 2020. We display clear product information (including price, origin, and return policy) before purchase and do not engage in misleading promotions or fake discounts.
•    Equal Treatment: We treat all customers fairly and do not discriminate based on profile or location. If Velvetra ever offers preferential deals or tie-ups (e.g. priority shipping to certain customers), this will be clearly disclosed.
•    Cancellation Charges: We do not impose cancellation fees on you except where Velvetra itself incurs such costs (e.g. restocking fees). If Velvetra cancels an order, no cancellation fee will be charged to you.
3. Use of Website and User Obligations
•    Lawful Use: You agree to use the website and its services only for lawful purposes. You will not post or transmit any unlawful, defamatory, obscene, or infringing material. In particular, you must not upload or share any content that violates intellectual property, privacy, or other rights of others. Velvetra’s Terms of Service explicitly prohibit illegal content, and we reserve the right to remove any content that violates laws or our policies. Under Section 79 of the IT Act, 2000, Velvetra is not liable for third-party content posted on the site provided we comply with due-diligence takedown notices.
•    Accuracy of Information: You must provide accurate and up-to-date information (billing, shipping address, payment details) when ordering. You are responsible for maintaining the confidentiality of your account login details and for all activities under your account.
•    Prohibited Conduct: You may not impersonate another person or entity, post spam or false reviews, or otherwise misuse the website. Velvetra does not allow false testimonials or paid reviews and may remove any such content.
•    Compliance: You agree to comply with all applicable laws and regulations (including import/export controls) when using our site. If you access Velvetra from outside India, you are responsible for compliance with local laws; Velvetra does not guarantee that our products or services comply with foreign regulations.
4. Product Information, Orders and Pricing
•    Product Display: We attempt to display product images and descriptions accurately. However, actual colors and dimensions may vary slightly from what appears on your screen. Minor color variations or pattern differences are normal and not considered defects. Sizing may vary within standard tolerances.
•    Ownership and Title: All products remain Velvetra’s property until full payment is received and the product is delivered to you.
•    Order Confirmation: Placing an order constitutes an offer to purchase subject to acceptance by Velvetra. Once we send a confirmation email, the contract is formed.
5. Payment, Payment Gateway, and Chargebacks
•    Payment Methods: We accept payment by credit/debit card, net banking, UPI, and other methods as stated on the site. All payments are processed through secure third-party payment gateways (e.g. Razorpay).
•    Payment Processing: By providing payment details, you authorize Velvetra to charge the amount due. Payment is debited and settled via the payment gateway into Velvetra’s account as per RBI Payment Aggregator regulations. Velvetra does not store sensitive card data; PCI and RBI guidelines are followed.
•    Gateway Liability: Velvetra is not liable for any unauthorized access to your payment account or any issues arising from the payment gateway provider’s systems. If a transaction fails or is reversed (for any reason, such as insufficient funds or suspected fraud), Velvetra may refund the debited amount to the source account once notified.
•    Refunds via Payment Gateway: If an order is cancelled or a return approved, refunds will be made using the original payment method (crediting your card or account). The refund process may take several business days due to bank/card network processing. As per standard practice, funds will be returned to the source of payment.
•    Chargebacks and Disputes: Any chargebacks or payment disputes must follow the banking/card network procedures. You should contact Velvetra first with any payment issues. Velvetra will assist with necessary documentation for legitimate disputes. Ultimately, any chargeback will be resolved under the relevant bank/card rules, and Velvetra’s liability for chargebacks is governed by those rules. Fraudulent chargebacks are not permitted. In case of chargeback, Velvetra will provide supporting proof of delivery and authorization.
6. Shipping, Delivery, Returns and Refunds
•    Shipping: Velvetra ships products via recognized courier services. Delivery timelines are estimates and may vary due to logistical delays. Velvetra is not liable for delivery delays beyond our control (e.g. force majeure, strikes, courier errors).
•    Delivery Acceptance: Upon delivery, you or the recipient must inspect the package immediately. If the package is damaged in transit, refuse delivery and contact Velvetra at once.
•    Return/Exchange Policy: Velvetra aims to comply with the Consumer Protection Act, which mandates that sellers cannot refuse return of defective or misdescribed goods. Accordingly:
o    Defective/Wrong Items: If you receive a damaged, defective, or incorrect item, you may request a return or replacement. Velvetra will arrange pickup (if applicable) and process the refund or exchange. We will not charge you restocking or cancellation fees in this case. Once the item is verified as defective, Velvetra will issue a refund of the full price (and any shipping paid) within 14 days of receiving the returned product. Refunds will be made as per the original payment method.
o    Intimate Products: Since Velvetra sells intimate apparel, we generally do not accept returns of innerwear or undergarments if the item has been opened or tried on, except in cases of proven defect or hygiene error. This is for health and safety reasons. Please check size charts carefully before ordering.
o    Exchange (Non-Defective): Exchange for a different size or style (if offered) must be requested within 7 days of delivery, in original condition and packaging. All sale and non-sale items may be subject to different exchange rules posted on the site.
o    Initiating Returns: To start a return or exchange, contact our Customer Support immediately with order details. Velvetra will provide instructions. Products must be returned in unused condition with all original tags and packaging, unless defective.
o    Refund Process: Once a valid return is received, Velvetra will credit your account promptly (subject to payment gateway timelines). You will receive an email confirmation when refund is initiated.
•    No Refusal of Defective Goods: Under the Consumer Protection Act, 2019, Velvetra cannot deny returns or refunds for defective goods, even if our policy states otherwise. We will comply fully with consumer rights in case of defective or misrepresented items.
7. Intellectual Property Rights
•    Velvetra IP: All intellectual property on this site is owned by Velvetra or licensed to us. This includes the Velvetra name and logo (trademarks), product designs, website text, graphics, images, videos, and software (copyrights), and any trade dress or trade secrets. You agree not to copy, reproduce, modify or misuse our IP.
•    Third-Party IP: Any content (images, text, designs) that we use which is owned by third parties (including stock images, licensed content, or AI-generated assets) is used under license or fair use. You have no right to use Velvetra’s content (or licensed content) without permission.
•    User Submissions: By submitting reviews, testimonials, photographs or other content to Velvetra, you grant us a royalty-free, perpetual, irrevocable license to display and use that content in any media for marketing and other purposes. You represent that your submissions do not infringe on any third-party rights.
•    Infringement: If you believe any content on the site infringes your rights, please notify us immediately.
8. Product Disclaimers and Limitation of Liability
•    No Warranty Beyond Description: Products are sold “as is” except as expressly described on our site or packaging. Velvetra makes no warranties beyond those mandated by law. We do not warrant that product colors will match your screen exactly or that sizes will fit perfectly beyond stated tolerances.
•    Minor Variations: Garments may have minor stitching irregularities or color variations (due to lighting, dye lots, or screen displays). Such slight variations are normal and do not constitute defects.
•    Limitation of Liability: To the maximum extent permitted by law, Velvetra and its affiliates, officers, employees and agents are not liable for any indirect, incidental, special or consequential damages (including loss of profits, data or goodwill) arising from the use of our site or products. Velvetra’s total liability (whether in contract, tort or otherwise) is limited to the amount you paid for the product in question.
•    Force Majeure: Velvetra will not be liable for any delay or failure to perform due to events beyond our reasonable control (e.g. acts of God, war, terrorism, strikes, pandemics, government actions).
•    Prescription / Advice: Products are for personal use only. Velvetra’s content is for informational purposes; it does not replace medical or professional advice.
9. Consumer Grievance Redressal Mechanism
•    In compliance with the Consumer Protection (E-Commerce) Rules, 2020, Velvetra has appointed a Grievance Officer. Customers can send complaints or feedback to:

We will acknowledge your complaint within 48 hours and endeavour to resolve it within one month as required by law. All complaints will receive a ticket number and you can track its status. If your grievance remains unresolved, you may escalate it to the Consumer Disputes Redressal Commission under the Consumer Protection Act.
•    We maintain records of all consumer complaints and redressal actions as required by law. We also cooperate with law enforcement agencies and regulatory authorities.
10. Governing Law and Dispute Resolution
•    Applicable Law: These Terms are governed by the laws of India. All statutory references (IT Act, Consumer Act, etc.) are to Indian law. We make no representation that our products or practices comply with laws outside India; customers abroad assume risk of compliance with local laws.
•    Jurisdiction: Any disputes arising out of these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
•    Arbitration: To the extent applicable, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996 (seat in Delhi), or other internationally recognized arbitration rules, at Velvetra’s discretion. The arbitration award shall be final and binding on both parties.
•    Severability: If any provision of these Terms is held invalid, the remaining provisions will continue in full force. A waiver of any provision or right must be in writing.
11. International and Export Considerations
•    Global Operations: Velvetra may expand internationally in the future. Customers outside India must ensure compliance with their own country’s import, tax, and trade laws. Velvetra does not guarantee compliance with foreign consumer protection or data laws.
•    Export Controls: Customers must not purchase products for resale or export to countries prohibited by applicable laws. You represent that you are not located in any embargoed country and not otherwise barred from receiving our products.
•    Currency and Taxes: All prices on the site are in INR (Indian Rupees) and include applicable GST. For international orders, currency conversion and customs duties (if any) are the responsibility of the buyer.
12. Miscellaneous Provisions
•    Entire Agreement: These Terms, along with our Privacy Policy, Return Policy and any order confirmations, constitute the entire agreement between you and Velvetra. These terms supersede all prior communications.
•    Assignment: You may not assign your rights or obligations under these Terms without Velvetra’s written consent. Velvetra may assign this agreement in connection with a merger or sale of assets.
•    Notices: Legal notices to Velvetra should be sent to the registered address. We will send notices to you via email or postal mail to the address on file.
•    Privacy: Personal data you provide is governed by our Privacy Policy (available on the website), which complies with IT Act and the Digital Personal Data Protection Act, 2023.
By using this site and/or purchasing from Velvetra, you confirm that you have read, understood, and agree to these Terms & Conditions. You acknowledge that Velvetra has disclosed all mandatory information and that you will abide by these rules when interacting with Velvetra’s website and products.
